Before you start

You can apply to amend or end a Section 173 Agreement on a land title. The application must address the matters identified in Section 178(B) of the Planning and Environment Act 1987.
Depending on the complexity of the agreement, the amending/ending proposal will be dealt with by council officers and may be referred to council's solicitors if required.
Council recommends getting advice from a legal practitioner before lodging an application. A legal practitioner may be required to identify the parties affected by the Section 173 Agreement.
Interested parties to the Section 173 Agreement may be notified of the proposal, as applicable.
If the proposal to amend or end a Section 173 Agreement is supported, you will be issued with a letter of Council's decision and either a Form 22 or Form 23 for you to take to Land Victoria (formerly the Land Titles Office) to register.

Asking to change an owner obligation in an agreement?

If your Section 173 agreement includes the phrase except with the prior written consent of Council, you can apply to change a requirement or owner obligation of the agreement.
To vary an obligation, you need to apply for consent (miscellaneous).
