Before you apply

When Council issues a planning permit, there are time frames in which you must start and finish your development or commence the use.

If you need more time for development or commencement of land use, you will need to ask for an extension to the planning permit.

If applying within 12 months after the permit expires, you must show proof that the project started before the permit expired and that all conditions were met.
For combined permits, subdivision expiry times are included.
Council and VCAT cannot extend permits beyond the specified times outlined in Section 69 of thje Planning and Environment Act 1987. You will need to apply for a new permit in such cases.

You must request in writing:

an extension to the planning permit any time before it expires
an extension to the commencement date for development or land use up to six months after the permit expires
an extension to the completion date for development up to 12 months after the permit expires.

We cannot approve requests beyond the relevant time period. Neither can the Victorian Civil and Administrative Tribunal (VCAT).

An extension of time is not approved automatically. We consider a range of criteria, including:

Whether there has been a change of planning policy
Whether the permit holder is "warehousing" it (i.e. waiting for a more advantageous time to start the permit)
the reason that the permit hasn't been started
The length of time that has passed since the permit issued
Whether the time originally given was sufficient to start the permit
Any economic burden imposed on the permit holder by the permit
The likelihood that a permit would be issued again if a new application be made

If you are not the landowner you will need to include written consent by the landowner authorising you to act on their behalf.

Prepare for your application by having supporting information and documentation ready.

Information you may be required to include with your application:

Construction timeline.
Details of building surveyor engaged.
Details of any contracts entered to proceed with works.
Details of any other plans or reports needed and completed to allow building approval.
Removal of trees that were part of the permit; or
Removal of structures that were noted to be removed as part of the permit; or
Construction of a driveway that was part of the permit; or
Commencement of construction (slab, floor, walls) of any structure that was part of the permit.
Site services (water, electricity, sewerage etc) has been installed at the site
Subdivision Certification has been issued (provided the application is a combined subdivision and development application).
